After arguing for a while, learned counsel for the petitioner submits that he would feel satisfied, if the instant petition is disposed of by directing the respondents to accord consideration to the case of the petitioner by treating the instant writ petition as a representation within some stipulated period and also in light of the law laid down by this Court in WP(C) No. 2472/2022, titled ‘M/s Saint Solider Engineer and Contractor Pvt. Ltd. vs. U.T. of J&K and Ors.’ 02. Learned counsels for the respondents submit that they are not averse to the aforesaid preposition, provided the case of the petitioner is directed to be accorded consideration under rules and as per law. 03. With the consent of the learned counsel for the parties, the instant writ petition is taken up for final disposal at the very threshold and, is accordingly, disposed of by directing the respondent No. 2 to treat the instant writ petition as a representation and to accord consideration within a period of four weeks from the date, a copy of this order as well as copy of the instant writ petition along with the annexure(s) are made available to the said Sr. No. 2 2 | P a g e WP(Crl) No. 156/2026 respondent, strictly under rules and as per law and also in light of the law laid down by this Court in the aforesaid case (supra). The order of consideration, which is likely to be passed be forwarded to the petitioner by the said respondent through registered post. 04. It is made clear that while according due consideration to the case of the petitioner by way of representation, respondents shall also accord due consideration to the communication issued by Chief Engineer, Jal Shakti (Irrigation & Flood Control) Department, Jammu, a perusal whereof reveals that respondents have admitted the liability of the petitioner to the tune of Rs. 89.72 lacs and that the Administrative Department, through the Principal Secretary to the Government, has been requested to release funds for clearance of the outstanding liability of the petitioner towards the work executed. 05.
