CRL OP No. 19302 of 2026 __________ Page2 of 6 02.07.2026 for the alleged offences under Sections 318(4), 296(b), 351 (3) of the Bharatiya Nyaya Sanhita, 2023 (BNS), in Crime No. 205 of 2026 on the file of the respondent police, seek bail. 2. The case of the prosecution is that the petitioners, along with the other accused, induced the de facto complainant and his father to invest a total sum of Rs.12,00,000/- in their finance concern, promising high returns. The petitioners repaid an amount of Rs. 4,00,000/-, failing to repay the balance amount of Rs. 8,00,000/-. Hence, the case. 3. The learned counsel for the petitioners submitted that the petitioners have been incarcerated since 02.07.2026. He further submitted that petitioners have been falsely implicated in the present case and that have not committed any offence as alleged by the prosecution. He further submitted that the petitioners are ready to abide by any stringent conditions that may be imposed by this Court. Hence, he prays for grant of bail to the Petitioners. 4. At this juncture, learned counsel for the Intervenor submitted so far, the petitioners have paid only the RS.4 lakhs. The remaining amount is yet to be paid. CRL OP No. 19302 of 2026 __________ Page3 of 6 Respondent Police reiterated the prosecution case and hence, opposed the grant of bail to the Petitioner. 6. I have given my anxious consideration to either side submissions and perused the materials available on record. 7.
At this juncture, in order to show their bonafide, the learned counsel for the petitioners volunteered himself to deposit a sum of Rs.2,00,000/-. 8. Considering the facts and circumstances of the case; taking note of the submission made by the learned Government Advocate (Crl.Side); though, this case has been registered as a case of cheating, from the submissions on either side, this Court could find that this case involves money transaction. Hence, this Court is of the firm view that further incarceration of the petitioners for the purpose of investigation is not required. Hence, this Court is inclined to grant bail to the petitioner subject to certain conditions. 9. Accordingly, the petitioners are ordered to be released on bail on their executing a separate bond for a sum of Rs.25,000/- (Rupees Twenty Five Thousand only) with two sureties each, for a like sum to the satisfaction of the learned Judicial Magistrate -1, Vellore, and on further conditions that: [a] the sureties shall affix their photographs and Left https://www.mhc.tn.gov.in/judis

The learned Magistrate shall obtain a copy of any one of the identity proofs to ensure their identity; [b] The petitioners are ordered to be enlarged on bail on condition that the petitioners shall deposit a sum of Rs.1,00,000/- (Rupees One lakh only) each totalling Rs.2,00,000/- (Rupees Two Lakhs only) to the credit of Crime No.205 of 2026 on the file of the respondent police within a period of four weeks from the date of their release. [c] On such deposit being made, the Trial Court shall redeposit the said amount in a Fixed Deposit Account, in any one of the Nationalised Banks, renewable thereafter periodically. The disbursal of this amount shall be decided at the culmination of the criminal case.
[d] the petitioners shall report before the respondent police daily at 10.30 a.m., for the period of two weeks and thereafter, as and when required for interrogation; [e] the petitioners shall not abscond either during investigation or trial; [f] the petitioners shall not tamper with the evidence or witness either during investigation or trial; [g] On breach of any of the aforementioned conditions, the learned Magistrate/Trial Court is entitled to pass appropriate orders against the petitioners in accordance with law as if the aforementioned conditions have been imposed and the petitioners released on bail by the learned https://www.mhc.tn.gov.in/judis
