“A. Issue an appropriate writ to direct the Respondent-State that the ratio of decision rendered by this Hon’ble Court in
judgment dated 07.05.2025 in CWP 1667/2021 (Annexure P-2) shall apply mutatis-mutandis to the case of the petitioner. 2 2026:HHC:2506

Issue an appropriate writ to quash clause 5 B of the 2019 policy along with its enabling rules to the extent of it states, “Whichever is later”, as the same is itself against the Industrial Policy 2019 r/w the judgments of the Hon’ble Supreme Court as stated above. C. Issue an appropriate writ to direct the Respondent-State to issue enabling notification under Clause 5B of the policy to disburse the benefits in terms of Clause 16(a) of the policy.”
2. Learned Additional Advocate General has placed on record communication dated 07.01.2026, sent by General Manager, Single Window Clearance Agency, Nalagarh, District Solan, H.P. to Director of Industries, Himachal Pradesh, whereby it has been informed as under:-
“1. The unit is registered in the name of M/s Sunoxx International, Village Panjhera, Swarghat Road, Tehsil Nalagarh, District Solan, H.P. vide bearing EM-II No. 02/009/13/71015 dated 01.09.2011 for the manufacturing of Batteries & Batteries Plates, Plastic containers & Parts for Batteries. The unit has started commercial production w.e.f. 31.03.2010 (Copy enclosed). 2. Further, it is submitted that the vide application dated 25.05.2022 the unit has applied in this office for provisional Certificate for the Change in the Name from M/s Sunoxx International to M/s Sunoxx International Pvt. Ltd. On the request of the unit this office has accorded provisional permission regarding change of name from M/s Sunoxx International to M/s Sunoxx International Pvt. Ltd. vide this office letter No. Ind/SWCA/NLG/EM-II/-205

CWP No. 188 of 2026 dated 25.05.2022 subject to condition that the unit will obtained necessary permission/licenses from the Pollution Control Board, GST Authorities, HPSEB Ltd, Labour Deptt. Fire Deptt. Permission U/s 118 Himachal Pradesh Tenancy and Land Reforms Act, 1972, Dept Revenue Deptt. etc. However, the unit has not submitted the above said regulatory approvals/licenses required for taken on record of the above said name change on permanent basis. 3. The unit has applied for taken on record of the change of name/Constitution vide application dated 28.08.2025. However, the unit has not submitted the above said necessary approvals/licenses required to acknowledge the name change from M/s Sunoxx International to M/s Sunoxx International Pvt. Ltd. Accordingly, the substantial expansion report dated 25.09.2023 has not been acknowledge by this office due to non-submission above said approvals/licenses.
It is further submitted that this office would require the above said permission/licenses from the unit and also need to re-examine the employment detail submitted by the unit in order to ascertain the eligibility of the unit for grant of incentives under the Himachal Pradesh Industrial Investment Policy, 2019.”
3. In aforesaid backdrop, learned counsel for the petitioner and learned Additional Advocate General are in agreement that petitioner shall approach the concerned authority, i.e., Director of Industries, Himachal Pradesh for redressal of his grievance, regarding eligibility of

CWP No. 188 of 2026 the unit for grant of incentives under the Himachal Pradesh Industrial Investment Policy, 2019, along with all documents, including necessary approvals and licenses within two weeks and, thereafter, Director of Industries shall pass a speaking and reasoned order in the light of the
judgment dated 07.05.2025, passed in CWP No. 1667 of 2021, titled as M/s Kundlas Loh Udyog vs. State of H.P. and others, within seven days thereafter.
4. Needless to say, petitioner shall at liberty to avail appropriate remedy, including approaching this Court, as permissible under law for redressal of grievance, if any, survives.
5. Accordingly, petition is disposed of in aforesaid terms, so also the pending applications, if any. (Vivek Singh Thakur),
