Petition under Article 226 of the Constitution of India praying that in the circumstances stated in the affidavit filed therewith, the High Court may be pleased to issue a Writ, Order, or Direction, more particularly one in the nature of a WRIT OF MANDAMUS any other appropriate writ, order, or direction, declaring the action of the Respondents in not releasing the final passed the pending due or payments of a total amount of Rs. 10,14,577/- (Rupees Ten Lakhs Fourteen Thousand Five Hundred and Seventy-Seven Only), even after finalization of the bills, payable to the petitioner in respect of the following works (i) An amount of Rs. 8,77,462/- (Rupees Eight Lakhs Seventy-Seven Thousand Four Hundred and Sixty-Two Only) towards the work, namely, Laying of C.C. Drain from Sri Gattu Mallaiah Temple to D.No. 17/547-3 Chowdamma Temple, Old Gooty Road, Tilak Nagar, 15th Ward, 15th Secretariat in Guntakal Municipality, executed under Agreement No. 39/GGMP/2022-23/E1, dated 06.12.2022, and Supplementary Agreement No. 89/2024-25/El, dated 11.06.2024, as recorded in M.Book No. 24/2024-25 and (ii) An amount of Rs'.
1,37,115/- (Rupees One Lakh Thirty-Seven Thousand One Hundred and Fifteen Only) towards the work, namely, Laying of Culvert in front of Mahendra Kalyana Mandapam, Tilak Nagar, 15th Ward, 15th Secretariat in Guntakal Municipality, executed under Agreement No. 40/GGMP/22- 23/E1, dated 06.12.2022, and Supplementary Agreement No. 70/2023- 24/El, dated 25.11.2023, as recorded in M.Book No, 100/2023-24 under GGMP Funds, as illegal, arbitrary, unjust, and violative of Articles 14, 21, and 300-A of the Constitution of India And consequently direct the Respondent authorities to release the said pending passed bill's amount of Rs. 10,14,577/- along with a reasonable rate of interest from the date the bill became due until the date of actual payment forthwith to the Petitioner, and pass IA NO: 1 OF 2026 Petition under Section 151 CPC praying that in the circumstances stated in the affidavit filed in support of the petition, the High Court may be pleased to direct the Respondents to provisionally earmark/secure the passed bill amounts of Rs. 10,14,577/- under M.Book No. 24/2024-25 & M.Book No. 100/2023-24 for the (2) works executed by the Petitioner, and pass Counsel for the Petitioner:

Order:-
The learned counsel for the petitioner submits that the petitioner was entrusted with the works i.e., (i) Laying of C.C. Drain from Sri Gattu Mallaiah Temple to D.No. 17/547-3 Chowdamma Temple, Old Gooty Road, Tilak Nagar, 15th Ward, 15th Secretariat in Guntakal Municipality, under G.G.M.P. Funds, vide Agreement No. 39/GGMP/2022-23/E1, dated 06.12.2022 and (ii) Laying of Culvert in front of Mahendra Kalyana Mandapam, Tilak Nagar, 15th Ward, 15th Secretariat in Guntakal Municipality, under G.G.M.P. Funds, vide Agreement No. 40/GGMP/22- 23/E1, dated 06.12.2022 .
2. It is submitted that the petitioner had completed the works entrusted to him and that the competent authority of the respondents had also approved the payments due and payable to the petitioner. The respondents have also recorded the progress of the works and the amounts due and payable to the petitioner in the M-Book.
3. Heard the submissions of the learned counsel for the petitioner, the learned Government Pleader for Municipal Administration and Urban Development Department, Sri G. Laxmi Narayana, learned Standing Counsel for the respondent Municipality and the learned Assistant Government Pleader for Finance and Planning.
4. During the course of hearing, the learned Standing Counsel appearing for the respondent Municipality submits that the works have been completed and that the petitioner has also submitted the final bills and the amounts due

and payable to the petitioner have been duly admitted. It is submitted that further funds are awaited and that, soon after the release of the funds, the bills due and payable to the petitioner shall be cleared.

Recording the submissions, this writ petition is disposed of at the admission stage, directing the respondents to verify and release the payments due and payable to the petitioner as expeditiously as possible, preferably within a period of six (06) weeks from the date of receipt of a copy of this
order. There shall be no order as to costs.
6. Pending miscellaneous petitions, if any, shall stand closed.
