AII INDIA COUNCIL FOR TECHNICAL EDUCATION, REPRESENTING BY ITS MEMBER - SECRETARY NELSON MANDELA MARG, VASANTH KUNG, NEW DELHI - 110070 ...RESPONDENT(S): Petition under Article 226 of the Constitution of India praying that in the circumstances stated in the affidavit filed therewith, the High Court may be pleased to issue an appropriate Writ, Order or Direction, more particularly one in the nature of a Writ of Mandamus, declaring the action of the 1st Respondent in not issuing the necessary No Objection Certificate (NOC) as recommended by the 2nd Respondent, Commissioner Higher Education vide E file No. 3151136 and consequential Government Order notifying the intake capacity of the newly approved Diploma Course in Artificial Intelligence and Machine Learning (Al and ML) with an intake of 60 seats for the Academic Year 2026-27, despite the Extension of Approval granted by the All India Council for Technical Education (AlCTE), and the consequential action of the 3rd Respondent in not granting affiliation to the said Diploma Course and restricting the Petitioner's sanctioned intake to 300 seats instead of the AlCTE-approved intake of 360 seats, as illegal, arbitrary, unreasonable, contrary to the provisions of the All India Council for Technical Education Act, 1987 and the Regulations framed thereunder, violative of Articles 14 and 19(1)(g) of the Constitution of India, and consequently direct the Respondents to permit the Petitioner to take admissions as per the intake capacity approved by the 5th Respondent, AlCTE for the Academic Year 2026-27, and pass IA NO: 1 OF 2026 Petition under Section 151 CPC praying that in the circumstances stated in the affidavit filed in support of the petition, the High Court may be pleased to direct the 1st Respondent to forthwith issue the necessary No Objection Certificate (NOC) in favour of the Petitioner institution for the newly approved Diploma Course in Artificial Intelligence and Machine Learning (Al & ML) with an intake of 60 seats, as recommended by the 2nd Respondent, Commissioner Higher Education vide E file No. 3151136 and consequently issue appropriate Government Orders duly notifying the intake capacity of the said new Diploma course for the Academic Year 2026-27 in terms of the Extension of Approval granted by the All India Council for Technical Education (AlCTE) and pass such other order or orders as this Honourable Court may deem fit and proper in the circumstances of the case, pending disposal of the above writ petition and to pass 3 IA NO: 2 OF 2026 Petition under Section 151 CPC praying that in the circumstances stated in the affidavit filed in support of the petition, the High Court may be pleased to direct the 3rd Respondent, State Board of Technical Education and Training (SBTET), Andhra Pradesh, to grant affiliation to the said Al & ML Diploma course with an intake of 60 seats and incorporate the same in the Petitioner's affiliation by restoring the total sanctioned Diploma intake of 360 seats, thereby enabling the Petitioner institution to participate in the AP POLYCET admission counselling and admit students against the AICTE- approved intake for the Academic Year 2026-27, pending disposal of the Writ Petition, and pass IA NO: 3 OF 2026 Petition under Section 151 CPC praying that in the circumstances stated in the affidavit filed in support of the petition, the High Court may be pleased May be pleased to vacate the interim order dated 03.07.2026 passed in W.P,No.17531 of 2026 and pass Counsel for the Petitioner: 1.
