2. Mr. Dinesh Chauhan, learned AGA with Mr. J.P. Kandpal, learned AGA, for the State of Uttarakhand.

In the High Court of Uttarakhand, the present case arises from Bail Application filed under Section 483 of Bharatiya Nagarik Suraksha Sanhita, 2023, seeking regular bail for the Applicant – Deepak Thakur, who has been accused in FIR No.0507 of 2025, dated 16.12.2025, under Sections 8, 22 and 29 of the NDPS Act, and under Sections 3 (5), 318 (4), 338, 336 (3) and 340 (2) of the BNS, 2023, at Police Station Kashipur, District Udham Singh Nagar.

Learned counsel for the Applicant submits that the Applicant is languishing in jail since 19.11.2025. He further submits that the Applicant has falsely been implicated in the present matter. It is also contended by the learned counsel for the Applicant that the Applicant was not named as an accused in the FIR. He further submits that the Applicant has no criminal history.

Learned counsel for the Applicant submits that the Applicant has been granted bail by this Court in BA 1st No.14 of 2026, vide judgment and order dated 27.02.2026, in connection with another FIR.
6. The bail application of the Applicant has been
vehemently opposed by the learned State Counsel.
7. Considering the overall facts and circumstances of the case, the Applicant has made out a case for bail.
8. Accordingly, bail application is allowed. It is directed that the Applicant - Deepak Thakur, who has been accused in FIR No.0507 of 2025, dated 16.12.2025, under Sections 8, 22 and 29 of the NDPS Act, and under Sections 3 (5), 318 (4), 338, 336 (3) and 340 (2) of the BNS, 2023, at Police Station Kashipur, District Udham Singh Nagar, be released on bail on furnishing a personal bond with two reliable sureties each in the like amount to the satisfaction of the concerned court. The Applicant shall cooperate with the trial proceedings and shall not misuse the liberty granted to him.
