Mr. Shibjit Mitra, Mr. Subhasish Mitra, ….for the petitioner This is yet another writ petition seeking demolition of alleged unauthorized construction without clearly specifying the nature or character of such construction. A perusal of the representation made by the petitioner reveals that it does not contain any specific particulars regarding the nature, extent, or description of the alleged unauthorized construction. The photographs annexed to the writ petition at pages 24 and 25 likewise do not prima facie disclose any ongoing or identifiable unauthorized construction. Although learned counsel for the petitioner submits that a boundary wall has been erected by respondent nos. 11 to 14, such assertion is not substantiated by cogent material particulars. The petitioner cannot reasonably expect this Court to direct initiation of demolition proceedings in the absence of clear and specific averments as to the 2 nature and extent of the alleged unauthorized construction. In writ jurisdiction, particularly when coercive action such as demolition is sought, the pleadings must disclose sufficient and precise material facts to warrant such intervention. Accordingly, W.P.A. 8506 of 2025 is dismissed. There shall be no order as to costs. The Photostat copy of this order, if applied for, be supplied to the parties on an urgent basis. (Kausik Chanda, J.)
