Sumer, learned counsel for the petitioners who has submitted that this application for grant of transfer has been made, the petitioners being seized of the fact that the case of the parties is before the Judge, District Council Court, East Khasi Hills District, Shillong. However, at present there are two Judges exercising concurrent power that is, Judge, District Council Court and Additional Judge, District Council Court, both of whom have since dealt with this matter in their capacity as Presiding Officers of the Subordinate District Council Court, East Khasi Hills District, Shillong. As such, under such circumstances, it would be but prudent for this matter to be transferred elsewhere. It the prayer of the petitioners that the instant petition be transferred to the court of the Judge, District Council Court, West Jaintia Hills District, Jowai. 2. Mr. R.S. Malngiang, learned counsel has entered appearance for the respondent and has no objection to the prayer made. 3. Without going into the merits of the matter, on the basis of the 2026:MLHC:807 3 submission made, this Court is inclined to allow the prayer. 4. Accordingly, the case between the parties herein pending before the court of the Judge, District Council Court, East Khasi Hills District, Shillong is hereby transferred to the court of the Judge, District Council Court, West Jaintia Hills District, Jowai. 5. Let copy of this order be issued upon the court of the Judge, District Council Court, East Khasi Hills District, Shillong for necessary action, that is, for transfer of the relevant case records to the court of the Judge, District Council Court, West Jaintia Hills, Jowai. 6. The learned Judge, District Council Court, West Jaintia Hills, Jowai is to take up the matter from the stage the matter was pending before the previous court. 7. Petition disposed of accordingly.
