The petitioner is aggrieved by the order as contained in Resolution No. 3 dated 20.10.2016 whereby the petitioner who was working as Para Teacher was disengaged. 3. After going through the record, I find that there is allegation against the petitioner that during inspection on 30.09.2016 the petitioner was found absent from 30.12.2013 to 16.04.2014 thus he was dismissed from service. 4. The respondents in their counter affidavit had stated that the petitioner was appointed as a Para Teacher and the nature of job is absolutely contractual. He joined the office on 08.02.2006 thereafter he worked regularly till 29.12.2013 for which he was paid salary. However from 30.12.2013 he remained unauthorisedly 2026:JHHC:2230 2 absent. Thus the matter was reported to the Block Development Officer who is head of the Block Education Committee and with his approval the petitioner was disengaged as per the instruction of BEEO. Thereafter the petitioner was again contractually engaged as Para Teacher, who joined on 09.7.2016 and he worked till 17.09.2016 and discontinued from 20.10.2016. As per the direction of Block Education Committee his services were terminated. 5. From the impugned order and the affidavit it is clear that before terminating the services of the petitioner, no notice was issued to the petitioner nor was given an opportunity of hearing. Thus on the ground of non-compliance of the principle of natural justice the impugned order is set-aside. The matter is remitted to the respondent no. 2-the Deputy Commissioner-cum-Chairman of Jharkhand Education Project, Jamtara to pass a fresh order after giving an opportunity of hearing to the petitioner to defend his case. 6.
