2. This application under Section 482 of BNSS, 2023 has been filed by the accused/petitioner, namely, Sri Anjom Hussain, seeking pre-arrest bail in connection with Barpeta P.S. Case No.357/2024, under Sections 376 of IPC (corresponding to GR No.1179/2024), which after completion of investigation is pending before the learned Court below at the stage of appearance.
3. However, it is pointed out by the prosecution, referring to order dated 16.10.2025 and 31.12.2025, that learned Court below has not only issued P&A and NBWA but on the basis of the same, has proceeded to issue an attachment order as well.
4. In view of the same and as per the law laid down in the case of State of M.P. Vs. Pradeep Sharma (2014) 2 SCC 171, it will not be possible on part of this Court to grant anticipatory bail to the petitioner and accordingly this petition stands dismissed and disposed of. JUDGE Comparing Assistant
