The instant petition under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023 has been filed seeking to grant anticipatory bail to the Petitioner / Accused No.4, in connection with Crime No.195 of 2021 on the file of Tanakal Police Station, Ananthampuramu which is registered for the offence under Section 34(A) read with 34(1) of A.P.Excise Act. 2. Sri Dheera Kanishka, learned counsel for the Petitioner would submit that the Petitioner is innocent of the alleged offence. Learned counsel

would further submit that no contraband was seized from the possession of the Petitioner and he was not present at the relevant time and place. It is further submitted that the FIR is of the year 2021 and till date, no charge sheet has been filed. Learned counsel would submit that the Petitioner is ready to furnish sureties to the satisfaction of the Court. Hence, prayed to grant anticipatory bail to the Petitioner. 3. Ms.K.Priyanka Lakshmi, learned Assistant Public Prosecutor vehemently opposed the petition and would submit that there are specific allegations against the Petitioner with regard to the commission of the alleged offence. It is further submitted that no case is made out to grant anticipatory bail to the Petitioner at this stage. 4. Considering the nature of the allegations and the specific accusations made against the Petitioner, this Court is of the view that it is not a fit case to exercise discretion in favour of the Petitioner at this stage. 5. In the result, the Criminal Petition is dismissed. The Petitioner is at liberty to surrender before the concerned Court and move regular bail application. On filing such application, the learned Judge may pass appropriate orders as expeditiously as possible in accordance with law.
As a sequel thereto, miscellaneous petitions pending, if any, shall stand closed. ________________________________________
