No.412 of 2026 ORDER This application has been filed under Section 9 of the Arbitration and Conciliation Act, 1996, [for brevity 'the Act'] for appointment of a receiver to seize and deliver the vehicle from the respondents to the applicant, if necessary, with police protection and by breaking open the premises. 2. Heard Mr.M.Arunachalam, learned counsel for applicant and also perused the materials available on record. 3. Pursuant to the orders made appointing the Receiver, the possession of the vehicle was taken from the respondent on 17.03.2026. 4. The private notice had been served supporting the tracking sheet. However, the service through Court is awaited. 5.From the award it could be seen that the respondents had earlier entered appearance before the Arbitrator through a counsel and thereafter, remained ex parte and thereafter, the award being passed. The respondents are liable to pay a sum of Rs.6,17,103/- together with interest @ 24% per annum from 05.07.2022 till realisation of the entire amount 2/4 https://www.mhc.tn.gov.in/judis Arb. Appln. No.412 of 2026 with cost of this proceeding. The award was passed as early as on 12.12.2022. It is the case of the applicant that as of the state no challenge to the award had been made, since no notice had been received from them till date. In spite of the vehicle being taken possession on 17.03.2026, the respondents had failed to appear before this Court. 6. In such view of the matter, this Court makes the order dated 26.02.2026 is made absolute. 7. Accordingly, this application stands disposed of.
