M.P. No. 1170 of 2026 by an order dated 04.06.2026 on the file of the learned Judicial Magistrate No. II, Alandur. https://www.mhc.tn.gov.in/judis CRL OP No. 18929 of 2026 __________ Page2 of 4 2. The second respondent is an accused in Crime No. 97 of 2026, registered for offences punishable under Sections 316(2) and 318(4) of the Bharatiya Nyaya Sanhita (BNS), on the allegation that the second respondent cheated the defacto complainant for a sum of Rs. 13 lakhs. It is alleged that the second respondent leased out a house to the defacto complainant by suppressing the fact that the property was under collateral security and subject to several liabilities. Consequently, the bank sealed the house in which the de facto complainant was residing on lease. 3. Pursuant to these allegations, the first respondent police registered the FIR, and the second respondent was arrested and remanded to judicial custody on 25.05.2026. Thereafter, the learned Judicial Magistrate No. II, Alandur, taking into consideration the facts and circumstances of the case and the period of incarceration, granted bail to the second respondent in Crl. M.P. No. 1170 of 2026 in Crime No. 97 of 2026 by an order dated 04.06.2026, subject to the following conditions: “6.In the result, bail petition is allowed and the petitioner is ordered to be released on bail with the following conditions: (i) The petitioner shall execute a bond for a sum of Rs.10,000/- with two sureties for a like sum each to the satisfaction of this Court and one surety must be blood relatives (ii) The petitioner shall appear and report before the respondent police station, daily morning at 10.30 a.m., for 20 days and thereafter shall appear before the respondent police as and when required for https://www.mhc.tn.gov.in/judis CRL OP No. 18929 of 2026 __________ Page3 of 4 interrogation. (iii) The petitioner shall comply the conditions imposed U/s.480(3) of BNS and the petitioner shall not commit and indulge in any subsequent offence and in case of any violation of the said conditions, the police are at liberty to file petition for cancellation of this bail (iv) the petitioner shall not abscond either during investigation or trial.” 4.It appears that the second respondent has duly complied with the conditions imposed. Therefore, this Court finds no valid grounds to cancel the bail granted to the second respondent. 5.Accordingly, this Criminal Original Petition stands dismissed. 17-07-2026 GBI To 1.
