No. 1656 of 2026 __________ Page3 of 5 ORDER This petition has been filed seeking direction to the 1st respondent to transfer the investigation and nominate an officer not below the rank of Superintendent of Police to conduct the investigation in Crime No.91 of 2026 to ensure a fair investigation. 2. Following the investigation of the FIR in Crime No. 91 of 2026, the 5th respondent informed the petitioner that the case was weak and, therefore, a positive charge sheet could not be filed. If no materials are available on record to sustain the charges, the 5th respondent shall close the FIR. if there are materials on record, the 5th respondent is directed to conduct a detailed and thorough investigation and file a final report, as the 5th respondent cannot be transferred. The 5th respondent is the competent person to conduct the investigation in Crime No. 91 of 2026, and at this juncture, transferring the file from the 5th respondent would affect the entire investigation. Further, the 5th respondent is directed to conduct the investigation fairly and complete it within a period of 12 weeks.
