A.Velmurugan ..Respondent(s) https://www.mhc.tn.gov.in/judis WP No. 27094 of 2026 __________ Page2 of 6 Prayer: This writ petition is filed under Article 226 of the Constitution of India, praying to issue a Writ of Mandamus directing the respondents 4 and 5 herein to survey the petitioner’s lands measuring an extent of 1-7.50 Hectares, comprised in Survey No.13/1C lands measuring an extent of 0-22.00 Hectares, comprised in survey No.13/2 and land measuring an extent of 0-40.00 Hectares, comprised in survey No.13/4, under patta No.351 in Vellimalai village, Kalvarayan Hills Taluk, Kallakurichi District under petitioner’s application NO. 2026/0123/33/002426 dated 08.06.2026 and as per his sale deed dated 24.07.2024 registered as Doc.No.2299/2024 at the Sub Registrar office, Vadakkanandal of the petitioner and to measure the boundaries and fix the measurement stone on the edges of boundaries in the above lands with the 6th Respondent police protection. Learned counsel for the petitioner would submit that the petitioner has made an online application dated 08.06.2026 to survey the petitioner’s lands measuring an extent of 1-7.50 Hectares, comprised in Survey No.13/1C lands measuring an extent of 0-22.00 Hectares, comprised in survey No.13/2 and land https://www.mhc.tn.gov.in/judis WP No. 27094 of 2026 __________ Page3 of 6 measuring an extent of 0-40.00 Hectares, comprised in survey No.13/4, under patta No.351 in Vellimalai village, Kalvarayan Hills Taluk, Kallakurichi District as per his sale deed dated 24.07.2024 registered as Doc.No.2299/2024 at the Sub Registrar office, Vadakkanandal and to measure the boundaries and fix the measurement stone on the edges of boundaries in the above lands with the aid of the 6th Respondent police. However, the same was not considered, as on date. Hence, this writ petition. 3. Mr.B.Pachaiyappan, learned Government’s Counsel accepts notice on behalf of the respondents 1 to 5 and submitted that the petitioner’s application dated 08.06.2026 will be considered within a period of six weeks. 4. Heard the learned counsel on either side and perused the materials available on record. 5. Considering the limited relief sought by the learned counsel for the petitioner, this Court without expressing any opinion on the merits of the case, directs the respondent to consider the petitioner's online application dated 08.06.2026 and carry out a survey and complete the process, after giving prior notice to the petitioner and other aggrieved parties, if any within a period of six (6) weeks from the date of receipt of a copy of this order. It is open to the fifth respondent to request for police protection before the sixth https://www.mhc.tn.gov.in/judis WP No. 27094 of 2026 __________ Page4 of 6 respondent/jurisdictional police. If any such request is made, the sixth respondent/jurisdictional police is directed to provide an adequate police protection for conducting the survey. 6. It is made clear that this order is passed only for the purpose of issuing a direction to the official respondent to conduct a survey and lay boundary stones at the subject land. In the event any dispute arises regarding the possession of the subject property, the same has to be decided by way of filing a suit before the competent Civil Court. 7. With the above direction, this writ petition stands disposed of.
