ATW 2022000/627 C 20250000 passed by the learned Judicial Magistrate No.I, Erode. https://www.mhc.tn.gov.in/judis CRL OP No. 19337 of 2026 __________ Page2 of 4 2.The petitioner made a strange complaint before the learned Judicial Magistrate stating that his father went missing on 05.04.2002, the learned Judicial Magistrate found that no cognizable offence is disclosed and as such rejected the complaint. 3.Upon hearing the learned counsel for the petitioner, the grievance is that the petitioner’s father has been missing from the year 2002 and they have been informally searching all these years. Now, when property issues are involved, the petitioner wants to approach the civil Court for declaration etc., The fact that the petitioner never gave a complaint comes in the way and therefore, now belatedly they are giving the complaint. In view thereof, in spite of the delay, though not much can be done to trace out the missing person, let a man missing complaint be registered by the respondent police and due attempts as per procedure by releasing posters, etc., can be made to trace out the person. If they are not able to trace out, they can file a final report as undetected.
