The Court made the following:
ORDER:
The Criminal Petition has been filed under Sections 480 and 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (for brevity, ‘the BNSS’), seeking to enlarge the petitioners/Accused Nos.1 and 2 on bail in NDPS S.C.No.25 of 2026 on the file of the learned I Additional District and Sessions Judge, Nellore, pursuant to the execution of the non-bailable warrant. 2. Heard the learned counsel for the petitioners and the learned Assistant Public Prosecutor. Perused the record. 3. As seen from the record, the petitioners are facing trial before the learned Trial Court. The case was posted for examination of the petitioners under Section 351 of ‘the BNSS’ (corresponding to Section 313 of ‘the Cr.P.C.,’) on 19.02.2026. The petitioners failed to appear before the learned Trial Court, and consequently, non-bailable warrants were issued against them. The said warrants were executed on 18.05.2026. The petitioners did not choose to file any application to recall the warrants after their issuance. The case is at the culmination stage. If the petitioners are enlarged on bail at this juncture, there is every likelihood of their again evading the process of law. If they remain in judicial custody for some more time, the learned Trial Court would be in a position to complete the trial and pronounce the judgment. Therefore, this Court finds no merit in the Criminal Petition. Accordingly, the Criminal Petition is liable to be dismissed. 3 Dr.YLR,J Crl.P.No.5361 of 2026 Dated 10.07.2026
4. In the result, the Criminal Petition is dismissed. As a sequel, Miscellaneous petitions, if any pending, shall stand closed. _________________________ DR.
