For Petitioner(s): Mr.S.Sivakumar For Respondent(s): Mr.M.Mohamed Riyaz Government Advocate ( crl side) ORDER The prayer in the Criminal Original Petition is to quash the final report in C.C.No.883 of 2025 on the file of the Judicial Magistrate No_II Panruti. 2. Upon perusing the material records of the case, it can be seen that originally in the complaint lodged by the defacto complainant the case registered in Crime no. 321 of 2023 for the alleged offences under sections 147, 148,294(b),323,324,506(2) of IPC r/w Section 4 of TN Prohibition of Harassment of Women Act, 2002 of I.P.C which was registered against the 11 accused. When the final report is filed, it is seen the same was filed against the first and second accused alone. It is the case of the police that the materials as disclosed in the statement of witnesses, the offence is made out as against the accused 1 and 2 and when deletion was proposed notice was issued to the defacto complainant and the defacto complainant filed objections. https://www.mhc.tn.gov.in/judis CRL OP No. 18051 of 2026 __________ Page4 of 6 3. The Trial Court thereafter considered the case of the petitioners and the the materials records of the case including the AR copy which reveals that the defacto complainant is attacked by 11 persons and held that the deletion is not permitted and directed adding of the said 9 persons as also the accused and decided to proceed further. 4. In the above circumstances, when the petitioners are now added as an accused pursuant to the said order, the Trial court has further made it clear that the P.W.-1 will be examined before the Court and further proceedings will be depending upon the evidence that is let in. The learned counsel only submits that the statement recorded under Section 161 of Cr.P.C does not contain any allegations as against the accused No. 3 to 11. It is exactly the said grievance of the L.W.1/defacto complainant and therefore the Trial Court has considered the issue and passed an order.
