This Criminal Miscellaneous Petition is filed praying to suspend the sentence of imprisonment and compensation passed against the petitioner in Crl.A.No.1145 of 2025 dated 04.03.2026 by the Honble XIX Additional City Civil Court, Chennai confirming the order passed in STC.No.1335 of 2021 dated 31.01.2024 by the Metropolitan Magistrate, Fast Track Court - 1, Egmore @ Allikulam, Chennai and enlarge the petitioner on bail pending disposal of the Criminal Revision Case. 2. The petitioner had filed the present Criminal Revision Case aggrieved by the conviction and sentence imposed by the learned Metropolitan Magistrate, Fast Track Court-I, Egmore @ Allikulam, Chennai, whereby the petitioner was found guilty of offence under Sec. 138 of the Negotiable Instruments Act and was sentenced to undergo simple imprisonment for the period of one year and was also ordered to pay the cheque amount as compensation by the trial court. As against the same, the petitioner had filed appeal in Crl. A. Subsequently, when the matter earlier came up before this Court, at the SR stage, this Court directed the petitioner to deposit the 50% of the cheque amount being Rs.4,87,500 before the trial court within two weeks. 3. Today, when the matter came up for hearing, the learned counsel for petitioner would produce the receipt No.10060 obtained from the trial court evidencing the deposit as directed by this Court. 4. In view of the same, the conviction and sentence imposed on the petitioner STC No.1335 of 2021 by the judgement dated 31.01.2024 by the learned Metropolitan Magistrate, Fast Track Court-I, Egmore @ Allikkulam, Chennai as confirmed by the judgement dated 04.03.2026 in Crl. Appeal No.1145 of 2025 by the learned XIX Additional Judge, City Civil Court, Chennai shall stand suspended and the petitioner shall be enlarged on bail on the following conditions :- (i) the petitioner shall execute a bond for a sum of Rs.50,000/- (Rupees fifty thousand only) with two sureties each for a like sum to the satisfaction of the learned Metropolitan Magistrate, Fast Track Court-I, Egmore @ Allikulam, Chennai; https://www.mhc.tn.gov.in/judis CRL MP NO. 11563 OF 2026 in CRL RC No. 1365 of 2026 __________ Page4 of 6 (ii) the petitioner shall sign before the learned Metropolitan Magistrate, Fast Track Court-I, Egmore @ Allikulam, Chennai on the first working day of every month until the disposal of the Criminal Revision Case and if he is not able to appear before the trial Court on any day, he shall make arrangements to file an application under Section 355 of BNSS, 2023 and shall appear before the trial Court on any other day in lieu of the date of his absence, as directed by the trial Court;. (iii) The petitioner and the sureties shall affix their photographs and Left Thumb Impression in the surety bond and the trial Court may obtain a copy of their Aadhar card or Bank pass Book and mobile numbers to ensure their identity; 6.
