2026:JHHC:1425 1 IN THE HIGH COURT OF JHARKHAND AT RANCHI W.P.(S) No. 244 of 2026 ------ Rajdeo Pahan son of Late Lilwa Pahan aged about 43 years resident of village Senegarh, PO-Rabodh, PS-Giddhi and District-Hazaribag. … … Petitioner(s) Versus 1. Manager, (Personal), Office of the Project Office, Giddhi C Colliery, CCL, PO & PS-Giddhi District-Hazaribag. 3. Project Officer, Giddhi C Colliery, CCL PO & PS, Giddhi, District-Hazaribag. 4. Staff Officer, (P&A) (A) Sirka, Giddhi C Colliery, CCL, PO & PS-Giddhi, District-Hazaribag. … … Respondent(s) ------ CORAM : SRI ANANDA SEN, J. ------ For the Petitioner(s) : Mr. Baban Prasad, Advocate Mr. Chandan Kr. Bhagat, Advocate For the Respondent(s) : Mr. Amit Kr. Das, Advocate Ms. Swati Shalini, Advocate ------ 02/ 20th January, 2026 1. Heard the parties. 2. It is the case of grant of compassionate appointment. 3. Admittedly, the father of the petitioner died on 24.06.2012. 13 years have lapsed and the family has tied over the immediate financial crises. 4. The Hon’ble Supreme Court in the case of “State of West Bengal Vs. Debabrata Tiwari & Ors.”, reported in (2025) 5 SCC 712 held that due to lapse of time, the family ties over the immediate financial crises, thus there is no necessity to grant compassionate appointment. 5. Further, in this case, I find that the claim of the compassionate appointment of the petitioner was rejected way back on 03.12.2012. This order is at Annexure-4. This order has not been challenged by the petitioner immediately, rather he has filed this writ petition in the year 2026, praying to re-consider the 2026:JHHC:1425 2 aforesaid order. Thus, on this ground also, I am not inclined to entertain this writ application, the writ application stands dismissed. (ANANDA SEN, J.) 20.01.2026 S.K.D., cp2 Uploaded on 24.01.2026
