For Appellant(s): Mr.M.Sivakumar ORDER This appeal has been filed against the order passed by the Commissioner of Worksmen’s Compensation in W.C.No.376 of 2015 dated 02.04.2017, rejecting the petition filed by the claimants on the ground of lack of jurisdiction. https://www.mhc.tn.gov.in/judis 2/4 CMA No. 2275 of 2026 2.Heard the learned counsel for the appellants and perused the materials available on record and also carefully went through the order passed by the authority. 3.In the case in hand, the accident had taken place when the vehicle was moving from Palakkad to Coimbatore. The owner of the vehicle is in Bangalore and whereas, the petition came to be filed in Vellore. The Deputy Commissioner of Labour by relying upon Section 21 of the Worksmen’s Compensation Act, held that the jurisdiction did not lie before the authority at Vellore. The jurisdiction will only vest on the authority in the place where the accident took place or where the dependents reside or where the employer has the registered office. None of these ingredients were satisfied. Hence, this Court does not find any illegality or perversity in the order passed by the Commissioner of Worksmen’s Compensation in W.C.No.376 of 2015 dated 02.04.2017 and accordingly, this Civil Miscellaneous Appeal stands dismissed.
