JUSTICE ANAND SHARMA Order 13/03/2026 1. Learned counsel for the petitioner submits that vide order dated 10.01.2026, the petitioner was transferred from Anand Sharma Govt. Girls Sr. Sec. School, Dausa to Govt. Sr. Sec. School, Aundmeena, Dausa. Learned counsel submits that the said [2026:RJ-JP:10706] (2 of 3) [CW-4602/2026] transfer order was causing grave prejudice and personal difficulty to the petitioner as her mother is suffering from incurable disease namely Cancer and post of Lecturer (Political Science), where the petitioner was transferred at Aundmeena, Dausa is not otherwise vacant for the reason that the person who was transferred from Aundmeena, Dausa to elsewhere has again been posted at the same place by canceling his transfer. Learned counsel submits that even the place at Anand Sharma Govt. Girls Sr. Sec. School, Dausa has been filled as the person who was transferred in place of Dausa petitioner has also joined. Learned counsel submits that by raising all these grievances, the petitioner filed appeal before Rajasthan Civil Services Appellate Tribunal, Jaipur however, the appeal has been decided by the Tribunal vide order dated 20.02.2026 without properly appreciating the facts of the case, material on record and law prevailing at the relevant time although, the grievances have been taken note of but no cogent finding has been given. 2. Issue notices to the respondents. 3. Ms. Pooja Sharma on behalf of Mr. Manoj Sharma, AAG appears and accepts notices on behalf of respondents. 4. Thereupon, learned counsel for the petitioner submits that the petitioner would be satisfied in case, she is permitted to submit a representation before the Director Secondary Education, Rajasthan, Bikaner with regard to her grievances who may pass an appropriate order under the circumstances. 5. In view of limited prayer made by learned counsel for the petitioner, this Court deems it just and proper to dispose of this writ petition with liberty to submit a representation before [2026:RJ-JP:10706] (3 of 3) [CW-4602/2026] respondent No. 2, who shall consider and pass an appropriate order within a period of 15 days from the date of receipt of representation and after verifying the vacancy position, the petitioner shall be posted strictly in accordance with law. 6. As the place from where the petitioner was transferred as well as even at transfer place, as stated by the petitioner, vacancies have been filled up therefore till decision over the representation of the petitioner, the petitioner shall report in the office of District Education Officer, Secondary Education, Dausa. 7.
