CRL OP No. 18717 & 18684 of 2026 __________ Page3 of 8 COMMON ORDER The petitioners apprehend arrest for the alleged offences under Sections 420, 465, 468 and 471 of IPC in Crime No.275 of 2026 on the file of the respondent police seek anticipatory bail. 2. The case of the prosecution is that the petitioners are employees of the Industrial Training Institute (ITI), Ambattur, and are State Government servants. While in service, they availed loans from the Central Co-operative Bank, Thousand Lights. During an audit, it came to light that the petitioners had forged their pay slips and a recommendation letter, purportedly issued by the Vice Principal of the Institute on the basis of which they fraudulently obtained a loan. Hence, the complaint. 3. The learned counsel for the petitioners submitted that the petitioners are innocent and a false case has been foisted against them and that they have not committed any offence as alleged by the prosecution.
Hence, he prayed to grant anticipatory bail to the petitioners. 4. Per contra, the learned Government Advocate (Crl.Side) appearing for the respondent police reiterated the prosecution case and submitted that based https://www.mhc.tn.gov.in/judis
CRL OP No. 18717 & 18684 of 2026 __________ Page4 of 8 on the fabricated documents, the petitioners have caused loss to the Central Cooperative Bank on failure of repayment of the loan amount. Hence, he opposed to grant anticipatory bail to the petitioners. 5. At this juncture, the learned counsel appearing for the petitioners in Crl.O.P.No.18684 of 2026 submitted that since the petitioners are Government employees, the entire outstanding amount payable to the Co-operative Bank would be deducted from their retirement benefits at the time of their superannuation. Hence, there would be no financial loss to the Central Co- operative Bank. 6. The learned counsel appearing for the petitioners in Crl.O.P.No.18717 of 2026 submitted that the second petitioner had already settled the loan obtained from the Central Co-operative Bank, and the loan account was closed on 10.06.2026. In support of this contention, he drew the attention of this Court to the closure letter issued by the Bank, which has been annexed to the typed set of papers. 7. Considering the nature of the allegations and the totality of the circumstances specifically that the petitioners are Government servants whose outstanding dues to the Co-operative Bank can be recovered from their salaries and retirement benefits, this Court is of the firm view that custodial interrogation of the petitioners is not required, notwithstanding the allegation of fabrication of documents. Hence, this Court is inclined to enlarge the petitioners on anticipatory bail, subject to certain conditions. 9.
Accordingly, the petitioners are ordered to be released on bail in the event of arrest or on their appearance, within a period of fifteen (15) days from the date on which the order copy is made ready, before the learned Judicial Magistrate, Ambattur on condition that each of the petitioners shall execute a bond for a sum of Rs.20,000/- (Rupees Twenty Thousand only), with two sureties each, for a like sum to the satisfaction of the learned Magistrate concerned, and on further conditions: (a)If the petitioners fail to surrender before the concerned learned Magistrate within a period of fifteen (15) days from the date of receipt of a copy of this order, this order shall stand automatically cancelled; (b) The sureties shall affix their photographs and left thumb impression in the application for surety slip (Judicial Form No.46 annexed to 'The Criminal Rules of Practice, 2019]'. CRL OP No. 18717 & 18684 of 2026 __________ Page6 of 8 learned Magistrate shall obtain a copy of any one of identify proofs to ensure their identity; (c) The petitioners shall report before the respondent police daily at 10.30 am for a period of two weeks and thereafter as and when required for interrogation; (d) On breach of any of the aforesaid conditions, the learned Magistrate/Trial Court is entitled to take appropriate actions against the petitioners in accordance with law as if the conditions have been imposed and the petitioners are released on anticipatory bail by the learned Magistrate/Trial Court himself as laid down by the Hon'ble Supreme Court in P.K.Shaji v.
