Contention of learned counsel for the petitioner is that the petitioner is recorded owner of land bearing Khasra No.980 /9, area 0.17 acres situated at Village Chandrapur, Tehsil Chandrapur, District Shakti (C.G.). After the construction of the kalma Bairaj, the aforesaid agricultural land of petitioner has come under submergence area of the Bairaj. Acquisition proceedings with respect to the land 2 under submergence have not been drawn, with respect to the land of petitioner. It is further contended that the petitioner has also filed representation (Annexure P-2) dated 19.01.2022, but the same has not been decided yet. As such, the petitioner is ready to file fresh representation for redressal of his grievance. Hence, learned counsel submits that this petition may be disposed of directing respondents No. 3 & 4 to decide representation filed by the petitioner and initiate land acquisition proceedings to grant compensation to the petitioner 3. Learned counsel for the State submits that if petitioner will file fresh representation, then the same shall be considered and decided in accordance with law. 4. I have heard learned counsel for the parties and perused the material available on record. 5. Having considered the limited prayer made by counsel for petitioner, without entering into the merits of the case, this petition is disposed of granting liberty to the petitioner to file fresh representation before respondents No. 3 & 4 alongwith all necessary documents and copy of this order within a period of 15 days from today. In the eventuality of filing such representation by the petitioner, the respondents No. 3 & 4 are directed to get demarcated the subject land of petitioner within further period fo 45 days from the date of filing of representation by the petitioner and if it is found that said land of petitioner has come in submergence area / affected area of the said Bairaj, then appropriate proceedings be initiated with regard to grant of compensation to the petitioner. Aforesaid proceedings with regard to acquisition / grant of compensation be concluded within further period of 90 days from the date of demarcation of aforesaid land of petitioner. 6. With the aforesaid observation & direction, the writ petition is disposed of. 7. Pending interlocutory application (s), if any, stands disposed of.
