Heard learned Counsel for the applicant and learned APP for the State. 2. By this application, the applicant is seeking bail in connection with Crime No.116 of 2024, registered with Police Station Rajapeth, Amravati City for the offences punishable under Sections 302, 34, 143, 147, 148, 149, 120-B, 201 of the Indian Penal Code. 3. Learned Counsel for the applicant submits that, for the same offences, on the ground of delay in trial, co-accused viz. Nilesh Dashrath Patel, was released on bail by order dated 27.08.2026, by this Court, in Criminal Application No.657 of 2026. The applicant is claiming parity as a ground for grant of bail. 4. Learned APP vehemently opposes the application by submitting that there are criminal antecedents against the applicant and he is directly 2026:BHC-NAG:11513 2 23. BA 126 of 2026.odt involved in the offence which is serious in nature. Under such circumstances, he prayed to reject the application. 5. Considering the observations in the order dated 27.08.2026, passed by this Court, in Criminal Application No.657 of 2026, in my opinion, same would be applicable to the present applicant. Hence, for the reasons recorded in the order dated 27.08.2026, the application is allowed on the following terms and conditions. ORDER (i) The criminal application is allowed and accordingly, disposed of. (ii) Applicant/accused viz. Aman Shital Mishra, be released on bail in connection with Crime No. 116 of 2024, registered with Police Station Rajapeth, Amravati City for the offences punishable under Sections 302, 34, 143, 147, 148, 149, 120-B, 201 of the Indian Penal Code on furnishing P.R. Bond of Rs. 50,000/- with one surety in the like amount. (iii) The accused shall not directly or indirectly make any inducement, threat or promise to any person acquainted with the facts of the case, as also shall not tamper with the evidence. 3 23. BA 126 of 2026.odt (iv) The accused shall provide his residential address and cell number to concerned Police Station and shall not change his place of residence without prior intimation to the concerned Investigating Officer. (v) The applicant/accused shall attend each and every date of trial regularly. If he fails to attend the trial for two consecutive dates or fails to comply with the aforesaid conditions, his default would entail the State to ask for cancellation of bail.
