AA5/ 3929923/2025 dated 20.01.2026 and quash the same and consequenlty direct the 1st respondent to remove the Iron gate erected by the 6th & 7th respondents and provide access to petitioner’s locked agricultural land situated in survey no 577/1 577/2, 579, 583/2, 583/3, 585/1 at Eduthupottan Colony, Valavanur Town, Villupuram District. The petitioner challenges the order dated 20.01.2026 passed by the first respondent rejecting his application under Section 133 Cr.P.C. seeking removal of a grill gate erected by the sixth and seventh respondents in Survey No. 580/1C. https://www.mhc.tn.gov.in/judis WP No. 16554 of 2026 __________ Page3 of 6 2. The petitioner states that he is a joint owner of agricultural lands situated in Survey Nos. 577/1, 577/2, 579, 583/2, 583/3 and 585/1 at Eduthupottan Colony, Valavanur Town, Villupuram District. According to him, he and his family have been using the lands in Survey Nos. 580/1C and 580/2B for ingress and egress for several decades. In 2013, the Panchayat laid a road under the NABARD Scheme for a length of 1,150 metres to provide access to these lands. The petitioner alleges that the sixth and seventh respondents subsequently erected a grill gate to prevent him and his family from using the road. He therefore filed an application under Section 133 Cr.P.C. seeking removal of the gate. By the impugned order, the said application was rejected. 3. Heard the learned counsel appearing for the parties and perused the materials on record. 4. The learned State Counsel, in the counter affidavit, submits that an enquiry revealed that the land measuring 29.0 acres in Survey No. 580/1C stands in the names of Subramania Gounder, son of Ramalingam, and two others. It is further stated that the sixth and seventh respondents formed the road on their private land for their personal use and that no cart track is reflected in the village accounts or the ‘A’ Register. 5. In view of the above, the dispute is essentially between private parties, and the petitioner must work out his remedy before the jurisdictional civil court. https://www.mhc.tn.gov.in/judis WP No. 16554 of 2026 __________ Page4 of 6 The first respondent, after conducting an enquiry, found that the property belongs to private individuals and that the dispute is purely civil in nature. Therefore, the impugned order cannot be said to suffer from any illegality. The petitioner’s claim of an easementary right over the subject property also requires adjudication by the competent civil court. 6. Accordingly, the writ petition is disposed of, reserving liberty to the petitioner to approach the jurisdictional civil court to establish his rights. If such proceedings are initiated, the civil court shall decide the matter independently, on the basis of the materials placed before it, without being influenced by any observations made in the impugned order. 7.
