Heard the parties. 2. The present writ petition has been filed for the following reliefs:- “(a). For issuance of an appropriate writ/writs, order/orders, direction/directions for quashing and setting aside the E-Auction Notice dated 23.12.2025 (Annexure-4) for E-Auction scheduled to take place on 10.01.2026 along with all consequential action, including restraining the respondent and its men, agents, servants from dealing with and or disposing of and/or creating any third party right, title and interest and/or encumbering and/or inducting anybody in the said immovable property in any manner whatsoever until the final disposal of S.A Diary No.03 of 2026 pendente lite before the Learned Recovery Tribunal, Ranchi which is currently not functional (b). Further the petitioners prays for the stay of the e- auction scheduled to take place on 10.01.2026 during the pendency of the instant writ application as the Learned Debt Recovery Tribunal, Ranchi is currently not functional and the 2026:JHHC:5009 petitioner have already preferred a Securitization Application before the Learned Debt Recovery Tribunal, Ranchi being S.A Diary No.03 of 2026 currently pending adjudication.” 3. Since the auction has failed as nobody has participated in the auction process and as such, there is no cause of action at present. 4. In that view of the matter, the present writ petition is hereby, disposed of reserving liberty with the petitioners to work out their remedy, if any cause of action arises in future.
