IV/ 558/ 17-70/A4 dated 30.04.2004 granted by the then Assistant Commissioner of Land Reforms, erode, Now held by the 3rd respondent, and pursuant to the order of this Court in W.P. No. 22119 of 2024 dated 11.12.2024. __________ Page3 of 7 https://www.mhc.tn.gov.in/judis WP No. 1442 of 2026 For Petitioner(s): Ms. L.Karthiga For Respondent(s): Mr.B.Pachaiyappan Government Counsel ORDER The present Writ Petition has been filed seeking the issuance of a Writ of Mandamus directing the 3rd respondent to consider the petitioners’ representation dated 27.12.2025. 2. The learned counsel for the petitioner submitted that the petitioners are residents of Kalangal Village, Palladam Taluk, and are eligible assignees under the Tamil Nadu Land Reforms (Fixation of Ceiling on Land) Act, 1961. It is further submitted that the petitioners were duly allotted surplus lands measuring between 1.20 and 1.33 acres each, by virtue of formal Assignment Orders dated 30.04.2004 However, despite the assignment, possession and patta were never issued. Following G.O.(Ms.) No. 1024 dated 31.12.2025, the authorities were required to allot alternative surplus lands. Though the petitioners submitted representation dated 27.12.2025 seeking issuance of patta and delivery of possession, no action was taken. Aggrieved by the inaction, the petitioners have __________ Page4 of 7 https://www.mhc.tn.gov.in/judis WP No. 1442 of 2026 filed the present writ petition seeking a direction to the respondents to allot alternative surplus lands, issue patta, and hand over peaceful possession in accordance with the assignment orders. 3. In response, Mr.B.Pachaiyappan, learned Government Counsel submitted that the representation of the petitioners dated 27.12.2025 would be considered by the respondents and appropriate orders would be passed thereon on merits and in accordance with law. 4. Considering the facts and circumstances of the case and the submissions made on either side, this Court, without going into the merits of the matter, directs the respondents to consider the petitioners’ representation dated 27.12.2025. The petitioners are directed to submit all relevant documents along with any binding judicial precedents passed by this Court to the respondents. Upon receipt of the same, the respondents, after issuing prior notice to the petitioners as well as the private respondents herein and affording them a fair opportunity of a personal hearing, shall pass a reasoned speaking order on merits and in accordance with law.
