This MCC has been filed by the applicant seeking restoration of Second Appeal No. 296/2019, which was dismissed for want of prosecution vide order dated 12.01.2026. 2. Learned Counsel for the applicants submits that on 12.01.2026, owing to inadvertence, no one appears on behalf of the applicants at the time of hearing. He further submits he 3 was constrained to leave urgently on account of a medical emergency concerning a family member. He submits that the absence was bona fide, unintentional, and neither deliberate nor with any intention to delay the proceedings. 3. Considering the submissions made and the reasons stated in the application, this Court is of the view that the applicant has shown sufficient cause for non-appearance on the said date. 4. Accordingly, the present MCC is allowed, subject to payment of costs of Rs. 5,000/- (Rupees Five Thousand only) to the Chhattisgarh High Court Bar Association Library Fund. 5. Upon deposit of the aforesaid costs, Second Appeal No. 296/2019 shall stand restored to its original number. 6.
