A perusal thereof, the allegation is that all these accused joined together and attacked the de facto complainant with a glass tumbler, and caused injuries on the left eyebrow of the de facto complainant. 3. The learned counsel for the petitioners would argue that some of the offences such as Section 296(b) of BNS etc., will not be made out in the absence of the clear-cut allegations relating to obscene words if any spoken. It was further submitted that the incident relates to a wordy quarrel between the students. 4. It may be true that some of the offences alleged will have to be considered by the trial Court during the course of the trial. However, when there is an Accident Register (AR) copy evidencing an injury and the Doctor who gave treatment to the de facto complainant is also examined, this is not a case, where this Court would entertain a quash petition, as there is some material against the petitioners to proceed with the trial, as such this criminal original 2 https://www.mhc.tn.gov.in/judis CRL OP No. 19025 of 2026 petition has no merits. 5. At this stage, the learned counsel for the petitioners would bring to the notice of this Court that all these petitioners are from Kerala and the alleged occurrence took place when they were studying their Nursing course in Tamil Nadu. 6. Considering the hardship pleaded, the personal appearance of the petitioners before the trial Court except for necessary hearings shall stand dispensed with.
