This appeal is directed against the order dated 09.07.2024 passed in Misc. Criminal Application No. 441 of 2024, Special POCSO Case No. 54A/21, corresponding to Chandwa, P.S. Case No. 131 of 2021 by learned Special Judge, POCSO, Latehar; whereby and whereunder the prayer for bail of the appellant has been rejected. 3. It appears that the appellant had earlier moved for grant of bail in Cr. Appeal (DB) No. 63 of 2024, which however was dismissed vide order dated. 18.04.2024. 4. It has been submitted by learned counsel for the appellant that in course of trial, one of the victims has been examined and she did not support the case of the prosecution. It has further been submitted that the appellant is in custody since 17.08.2023. 5. Learned A.P.P. has opposed the prayer for bail of the appellant. 6. There appears to be two victims and though one of 2026:JHHC:6264-DB 2 the victims have not supported the case of the prosecution; but the other victim has not been examined. In fact, in the statements of the victim under Section 164 Cr.P.C., they have asserted that the appellant had committed rape upon both of them. It has also been found that the victims are minors. 7. On consideration of the aforesaid facts, we are not inclined to entertain this appeal and consequently the same stands dismissed at this stage. (Rongon Mukhopadhyay, J.) (Deepak Roshan, J.)
