Petitioners claim to be the owner of LR Plot No. 490, Khatian No. 184 within Mouza – Mollabelia in the district of Nadia. Petitioners allege that a metal road has been constructed over the property of the petitioners without initiating any proceeding for requisition and acquisition. In the writ petition a photograph has been annexed showing that a road has been constructed. However, without a proper demarcation exercise being carried out by the competent authority, it cannot be ascertained whether the metal road has been constructed over LR Plot No. 490. Petitioners have submitted a representation dated February 12, 2025 before various authorities
2 including the District Land and Land Reforms Officer, Malda. Mr. Banerjee, learned advocate appearing for the State submits that no material has been produced by the petitioners in support of the claim that the metal road has been constructed on the property of the petitioners. He further submits that from the photograph annexed to the writ petition it cannot be ascertained whether the metal road is on the property of the petitioners or on some other plot. Thus, it appears from the submissions made by the learned advocate appearing for the respective parties that it is to be decided whether any metal road has been constructed on the petitioners’ property being LR Plot No. 490. In view thereof, this Court directs the District Land and Land Reforms Officer, Nadia to consider the representation of the petitioners dated February 12, 2025 and, after causing demarcation of the disputed plot in question upon prior service of notice to the petitioners and any other party who may be affected by such demarcation, prepare a report and the sketch map and shall serve the same to the petitioners immediately thereafter. The entire work of demarcation including the supply of the report to the
3 petitioners, shall be made as expeditiously as possible but positively within a period of eight weeks from the date of receipt of a server copy of this order along with a copy of the representation dated February 12, 2025.
If it is found that the metal road has been constructed on the property of the petitioners, the District Land and Land Reforms Officer shall also indicate in the said report, the authority who constructed the metal road. With the above observations and directions, this writ petition stands disposed of. (Hiranmay Bhattacharyya, J.)
