CRL OP No. 8810 of 2026 __________ Page2 of 4 ORDER This petition has been filed seeking the cancellation of the bail granted to the second respondent herein in Crl.M.P.No.1817 of 2025, by an order dated 07.11.2025, on the file of the learned Principal District and Sessions Judge, Perambalur. 2.The learned counsel for the petitioner submitted that after obtaining bail, the second respondent sold the subject land and absconded. However, the second respondent has engaged counsel, who submitted that the second respondent did not sell the property. Instead, by operation of law and due to a default on the loan amount, the second respondent’s property was sold by the mortgagee. When this Court raised a pertinent question as to whether any condition was imposed regarding the sale of the subject land, the learned counsel for the petitioner fairly admitted that the bail order contained no such condition restricting the sale. Therefore, under these circumstances, even though the property has been sold, it was not sold by the second respondent; rather, the sale was effected by operation of law through an auction. In view of these circumstances, this Court finds no grounds to cancel the bail. Furthermore, as per the submissions made by the learned Government Advocate (Criminal Side), the charge sheet has already been filed in this case. https://www.mhc.tn.gov.in/judis
