Allow this petition under Section 528 of B.N.S.S. filed by the petitioner. II. Quash the impugned FIR dated 13.11.2024 bearing Crime No. 124/2024 registered at Police Station, Kusmi, District-Balrampur- Ramanujganj (C.G.) for the offence U/s 64(1) of Bhartiya Nyay Sanhita against the petitioner. III. Quash the impugned Final Report No. 104/2024 filed by Police Station, Kusmi, District-Balrampur-Ramanujganj before the learned Judicial Magistrate First Class, Rajpur, District- Balrampur-Ramanujganj against the petitioner. 2 IV. Quash the cognizance order dated 21.02.2025 (Annexure P/2) and entire criminal proceedings pending in Sessions Trial No. 42/2025 before the learned Sessions Judge, Balrampur place at Ramanujganj against the petitioner. V. Gran any other relief, which may be deemed fit in given facts and circumstances of the case, in favour of petitioner. 2 At the outset, the counsel for the State has pointed out that the petitioner has come up with the aforesaid prayer of quashment of proceeding, but the statement of victim/complainant has been recorded by the trial court, a copy of the which has been annexed at page No.64 of the petition. 3 In view of aforesaid submission made by the counsel for the State, the counsel for the petitioner submits that since the victim has turned hostile and petitioner being a government servant, the proceeding be quashed. 4 Considering the submissions made by the counsel for the parties, as the trial is in substantial progress and victim has already turned hostile, we do not find any good ground for interference at this advanced stage. 5 Accordingly, the present petition stands dismissed leaving it open to the trial court to proceed with the trial and conclude the same expeditiously.
