Shukla, A.P.P. ------ 2/03.02.2026 Heard learned counsel appearing on behalf of Petitioners and learned counsel appearing on behalf of the State. 2. The petitioners are apprehending their arrest in connection with Pratappur P.S. Case No. 201/2021, corresponding to G.R. No. 704/2023 for the offence registered under section 147, 148, 149, 341, 323, 324, 325, 307, 448, 354(B), 379 and the learned trial court took cognizance u/s 147, 148, 149, 341, 323, 324, 325, 307, 448, 354(B) 504, 379 and 506 of the Indian Penal Code, pending in the Court of learned Sub-Divisional Judicial Magistrate, Chatra. 3. Learned counsel appearing for the petitioner submits that there are general and omnibus allegation against the petitioners of assault and the altercation took place due to land dispute. He also submits that the charge sheet has been submitted against the bailable sections, however, the learned court has been pleased to take cognizance under 2026:JHHC:2724 2 Section 307 of IPC. In view of that, the petitioners have filed anticipatory bail application. He also submits that the petitioners have got no criminal antecedent as disclosed in para 14 of the petition. 4. Learned counsel appearing for the state opposed the prayer and submits that the allegations are there of assault. 5. Considering that there are case and counter case between the parties and the police has submitted charge sheet against the bailable sections, however, the learned court has been pleased to take cognizance under Section 307 of IPC, in view thereof, the petitioner above named petitioners are directed to surrender before the learned Court within two weeks and the learned Court shall release the petitioners on such terms and condition or sureties, the learned Court may deem fit and proper.
