Ms. Prabha Naithani, learned counsel for the petitioner. 2. Ms. Meenakshi Sharma, learned AGA for the State. 3. Mr. Harshit Bisht, learned counsel for the complainant. 4. By the instant petition, petitioner is praying for quashing of the FIR dated 05.02.2026 bearing FIR No. 34 of 2026, Police Station – Ram Nagar, District – Nainital which was lodged against some unknown persons for the offence punishable under Section 305 (a), 317 (2) BNS, 2023. 5. The instant petition is filed along with compounding application supported with the affidavit of petitioner and complainant. 6. Petitioner joined the proceedings through V.C. and complainant is present in person and both are identified by their respective counsel. 7. It is contended by the complainant that stolen article has already been recovered and now, the complainant has no grudge against the petitioner and he do not want to proceed with the FIR. 8. Learned State Counsel submits that offence is not compoundable but with the leave of the Court the same can be compounded. 9. After hearing the learned counsel for the parties and taking into consideration that the complainant does not want to pursue with the impugned FIR, this Court is of the view that there is no useful purpose to go with the investigation, particularly, when respondent complainant does not want to pursue the FIR. 10. Accordingly, writ petition and compounding application are allowed. Impugned FIR is also hereby quashed. (Rakesh Thapliyal, J.) 14.05.2026 SKS
