P.P. …...... 02/ 17.03.2026: This bail application has been filed by the petitioners under Sections 483 & 484 of BNSS, 2023 wherein, prayer has been made for grant of bail as they are in custody for allegedly committing offence punishable under Sections 317(5)/3(5) of BNS, under Sections 11(1)(a)(d)(e)(f) Cattle Cruelty Act and under Sections 12(1)(2)(3)/13 of Jharkhand Bovine Animal Prohibition of Slaughter Act. 2. Heard, learned counsel for the petitioner, learned counsel for the State and have also gone through the impugned order. 3. Learned Spl. P.P. opposes the prayer for bail. 4. It is alleged that the petitioners were transporting bovine animal in the vehicle. 5. The chargesheet has already been submitted in this case. Petitioners are in custody since 18.01.2026. Similarly situated, co- accused have been granted bail by co-ordinate Bench of this Court vide order dated 13.03.2026 passed in B.A. No.1892 of 2026. 6. Considering the period of custody and the fact that chargesheet has been submitted and similarly situated, one of the co-accused has been granted bail, I am inclined to grant bail to the petitioners. Accordingly, the petitioners, named above, are directed to be released on bail on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate, 1st Class, Jamtara, in connection with Mihijam P.S. Case No.02 of 2026, subject to the condition that one of the bailors should be a close relative of the petitioners, having sufficient landed property in his own name within the State of Jharkhand.
