Heard the learned counsel appearing for the respective parties.
The petitioner is an accused in connection with Nawadih P.S. Case No. 57 of 2025.
A dacoity was committed in the house of the informant and the informant and his family members were also assaulted. The dacoits had looted cash and other articles.
Submission has been advanced by the learned senior counsel for the petitioner that he has been implicated on the confession of co-accused. Learned senior counsel submits that neither there has been any recovery from the possession of the petitioner, nor any Test Identification Parade has been held. It has been submitted that one of the co-accused has been granted bail in BA No. 10917 of 2025. The petitioner is in custody since 31.01.2026.
Learned A.P.P. has opposed the prayer for bail of the petitioner.
Regard being had to the fact that no material of substance has been collected against the petitioner save and except the confessional statement of co-accused, he is directed to be released on bail on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, Bermo at Tenughat in connection with Nawadih P.S. Case No. 57 of 2025.
