Present bail application has been filed seeking grant of regular bail in connection with F.I.R./Case Crime No. 324 of 2025, registered under Sections 420, 427, 467, 468 & 471 I.P.C. at Police Station Gadarpur, District Udham Singh Nagar. 4. Heard learned counsel for the parties and perused the material available on record. 5. Present bail application has been filed seeking grant of regular bail in connection with F.I.R./Case Crime No. 324 of 2025, registered under Sections 420, 427, 467, 468 and 471 I.P.C. at Police Station Gadarpur, District Udham Singh Nagar. 6. Heard learned counsel for the parties and perused the material available on record. 7. Learned Senior Counsel appearing for the applicant would submit that the impugned F.I.R. has been lodged by the Lekhpal of the Irrigation Department alleging therein that the applicant, by preparing forged and fabricated 2026:UHC:3835 documents, illegally sold a small portion of land belonging to the Irrigation Department to several persons. 8. Learned Senior Counsel for the applicant would further submit that the applicant is innocent and has falsely been implicated in the present case; that, the applicant has been residing in the locality for the last several decades; that, the applicant had merely handed over possession of a small piece of land measuring about 30 x 40 feet to one Khushi in the year 2018; that, no ingredients of the offences alleged are made out against the applicant; that, the applicant neither forged any government document nor represented himself to be the bhumidhar/owner of the land in question; and that, the prosecution story is wholly misconceived. 9. He would further submit that the applicant is in judicial custody since 10.12.2025; that, the alleged transaction pertains to the year 2018, whereas the present F.I.R. came to be lodged only in December, 2025 after an unexplained delay of about seven years; that, the entire prosecution case rests upon documentary evidence, which is already in possession of the prosecution and, therefore, there is no likelihood of tampering with the evidence; that, the applicant is a permanent resident of District Udham Singh Nagar and there is no possibility of his absconding or fleeing from the course of justice; and that, the trial is likely to take considerable time in its conclusion, therefore, prayer has been made to 2026:UHC:3835 enlarge the applicant on bail. 10. Per contra, learned State Counsel would oppose the bail application. However, he does not dispute the fact that the applicant has not described himself as bhumidhar of the land in question and that the applicant is in judicial custody since 10.12.2025. 11. Having considered the submissions advanced by learned counsel for the parties, perused the material available on record, and considering the overall facts and circumstances of the case and without expressing any opinion on the merits of the case, this Court is of the view that the applicant has made out a fit case for grant of bail. 12. Accordingly, the bail application is allowed. 13. Let the applicant, Asgar Ali, be released on bail in the aforesaid case crime number on his furnishing a personal bond and two reliable sureties each in the like amount to the satisfaction of the court concerned.
