This application under Section 482 of BNSS, 2023 has been filed by the petitioner, namely, Sri Nityananda Kaman seeking pre-arrest bail in connection with Hajo P.S. Case No. 519/2025, under Section 125(b)/303(2) of BNS, 2023, read with Page No.# 2/2 Section 13(1) of Assam Cattle Preservation Act, read with Section 11(1)(d) Prevention of Cruelty to Animals, read with Rule 125 Central Motor Vehicles Rules, 1989, (Corresponding GR No. 642/25).Call for the Case Dairy from the concerned P.S. As per the FIR, one vehicle bearing registration No. AS-01-NC-9429, carrying 20 (twenty) numbers of life cattle was apprehended by the police on 15.12.2025, but the driver and the handy man managed to escape and the vehicle as well as the cattle have been seized. It is submitted on behalf of the petitioner that he is the final purchaser of the said cattle and he is registered under the Animal Husbandry & Veterinary Department as a dealer of cattle and in this regard, the registration certificate has been annexed as Annexure–2 to the instant petition. It is further submitted that the petitioner was in no way involved in the transportation of the cattle and he was supposed to receive the cattle at his farm in Silchar. It is submitted by the prosecution that, in the meantime, the investigation stands completed and has resulted in the charge-sheet. The learned counsel for the petitioner has reiterated his earlier submission that he has possessed the cattle legally and that, in the meantime, the learned Court below has also given interim custody of the cattle to him. In any case, in view of completion of the investigation, the interim bail granted to the petitioner vide order dated 08.01.2026 is made absolute subject to the conditions that he shall co-operate with the trial, if one commences and he shall not hamper or tamper with the evidence. The learned Additional P.P submits that the charge-sheet No. 54/2026 dated 27.02.2026 has been filed. The anticipatory bail application stands disposed of. JUDGE Comparing Assistant
