For issuance of appropriate writ(s) / order(s) / direction(s) or a writ in the nature of Certiorari for quashing the illegal and arbitrary order dated 06.12.2022 passed by the Circle Officer, Deoghar (Annexure-6), whereby and where under Mutation Case Number 735 R27/ 2022 2023/Deoghar has been rejected on the purported ground that the subject land is under the purview of an ongoing CBI investigation; ii. For issuance of appropriate writ(s)/order(s)/direction(s) or a writ in the nature of mandamus directing the Respondents to carry out the mutation in favor of Petitioner 2026:JHHC:4950 Page | 2 W.P. (C) No.125 of 2025 no.1 for the land parcel of Basauri transferable Land measuring 1475 sq. ft. in Mouza Madarichak, Thana No. 256, Town Plan Plot No. 368 D, Portion of Survey Plot No. 155, Sub-plot No. 9 &10, Jamabandi No. 26/3634 within Deoghar municipal corporation ("Subject Land"); AND iii) For issuance of appropriate writ(s) / order(s) / direction(s) or a writ in the nature of mandamus directing the Respondents to issue a Land Possession Certificate ("LPC") for the registration of the land parcel of Basauri transferable Land measuring 1475 sq. ft. in Mouza Madarichak, Thana No. 256, Town Plan Plot No. 368 D, Portion of Survey Plot No. 155, Sub-plot No. 9 & 10, Jamabandi No. 26/3634 within Deoghar municipality ("subject land");” 2. Learned counsel for the petitioners has claimed that the petitioners had acquired the land through certain process. Movement of the title has been shown but the fact remains whether the seller was the mutation holder or not. That fact has not been disclosed by him. At best, it is a case of transfer mutation. Earlier mutation holder had not been even made party who is necessary party whose name has to be deleted from the Register-II. Thus, this writ petition is lacking the necessary particulars. 3. In that view of the matter, I am not inclined to entertain the present writ petition. Accordingly, the present writ petition is hereby dismissed. (Rajesh Kumar, J.)
