For Petitioner(s): Mr.M.Saravanakumar https://www.mhc.tn.gov.in/judis CRL OP No. 18965 of 2026 __________ Page2 of 4 Order Today, the matter is listed under the Captain “For Maintainability”, The petitioner seeks a direction to the District Consumer Disputes Redressal Commission, Tiruvallur to consider and dispose of the warrant recall application filed in EA No.30/2025 in CC No.29/2025 within a time frame. 2.Once execution proceedings has been initiated, any grievance relating to the warrant issued has to be redressed before the concerned Commission or such appropriate forum. The inherent jurisdiction of this Court under Section 528 of BNSS, 2023 cannot be invoked to issue direction in respect of such execution proceedings. 3.The learned counsel for the petitioner placed reliance upon the order of this Court in Crl.O.P.(MD).No.1868 of 2019. A perusal of the said order shows that the matter was considered only on the question of maintainability. In the peculiar facts of the case, the petitioner had voluntarily expressed willingness to pay the entire award amount, and it was only in that context, this Court observed that the warrant would be recalled upon such payment. However, liberty is granted to the petitioner to move the very same Executing Court or such other appropriate forum in the manner known to law.
