1. Heard Mr. Mahipal Singh, learned counsel of this Court / petitioner appearing in person, Mr. Nand Lal Maurya, learned Standing Counsel for the State-respondents and Mr. Arun Kumar Pandey, learned counsel for the Goan Sabha.
2. The instant petition has been filed for mandamus directing the respondent no.1/ Sub-Divisional Magistrate, Najibabad, District- Bijnor to decide the Suit No.5406 of 2024 (Mahipal Singh vs. Satyapal Singh and others) within stipulated period.
3. Learned counsel for the petitioner submitted that the aforementioned suit for division of holding is pending before respondent no.1 since 21.12.2024. He further submitted that the copy of order sheet of the case has been annexed as Annexure No.5 to the petition in order to demonstrate that the case is not proceeding expeditiously.
4. Without expressing any opinion on merits of the case and keeping in view of the facts and circumstances, respondent no.1 is directed to decide the aforementioned suit after giving an opportunity of hearing to the parties in accordance with law expeditiously preferably within a period of four months from the date of production of certified copy of this order before him.
