For Petitioner(s): Mr.R.Thirumoorthy For Contemnor(s): Mr.Durai Gunasekaran Counsel for Government of Tamil Nadu https://www.mhc.tn.gov.in/judis 2/6 CONT P No. 1846 of 2026 ORDER This contempt petition was filed against the Inspector of Police, Banavaram Police Station on the ground that the FIR in Crime No.114 of 2023 became a subject matter of challenge in Crl.O.P.No.1823 of 2024 and this Court entertained the quash petition and granted an order of interim stay of investigation, pending disposal of the petition on 02.02.2024 and that in spite of the stay granted by this Court, the Investigation Officer proceeded with the investigation and filed a police report which was taken on file by the learned Judicial Magistrate Court, Sholinghur in C.C.No.289 of 2025. 2.When the contempt petition came up for hearing on 03.07.2026, this Court passed the following order: This Contempt petition has been filed against the respondent for wilful disobedience of the order dated 02.02.2024 passed by this Court in Crl.M.P.No.1303 of 2024 in Crl.O.P.No.1823 of 2024. 2. Mr.Durai Gunasekaran, learned Additional Public Prosecutor, takes notice for the respondent. 3. It is the grievance of the petitioners that in spite of the order of interim stay granted by this Court on 02.02.2024, the respondent has proceeded to complete the investigation and file the final report before the https://www.mhc.tn.gov.in/judis 3/6 CONT P No. 1846 of 2026 learned Judicial Magistrate, Sholinghur on 20.12.2024. 4. Post this contempt petition on 17.07.2026 at 2.15 p.m. The respondent shall be present before this Court on the next date of hearing. 3.Pursuant to the above order, Mr.R.Lakshmipathi, Inspector of Police, DCB-Chengalpet (Mobile:94981 46225) was present before the Court and an affidavit has also been filed. On going through the affidavit, it is seen that the police report was filed on 31.07.2024 before the learned Judicial Magistrate Court, Sholinghur and it was taken on file in C.C.No.289 of 2025. The Police officer has tendered his unconditional apology and has explained that the then Inspector of Police did not bring to the knowledge of the law officer concerned regarding the order of stay granted by this Court and due to lack of communication, the investigation was proceeded further and the police report was filed before the Court. 4.In the considered view of this Court, the investigation conducted and the police report filed, which was taken on file in C.C.No.289 of 2025, in the teeth of interim stay granted by this Court, must be treated as non est in the eye of law. Hence, proceedings pending in C.C.No.289 of 2025 are liable to be held illegal. Accordingly, the proceedings pending in C.C.No.289 of 2025 on the file of the learned Judicial Magistrate Court, Sholinghur, is hereby quashed and the https://www.mhc.tn.gov.in/judis 4/6 CONT P No. 1846 of 2026 matter is restored back to its original position.
