W.P.No.28723 of 2026 __________ Page2 of 7 the Petitioner thereby directed to vacate the property situated at S.No.927-4477 Sq.ft, 928-360 Sq.ft at Door No.94, 95, Vijayapuram, Thiruvarur Taluk and District total measuring about 4837 Sq.ft when the revision petition filed in R.P.No.101 of 2025 on the file of the 1st Respondent and consequently, direct the 3rd Respondent not to take any further steps thereby evicting the Petitioner from the above said property till the disposal of R.P.No.101 of 2025 on the file of the 1st Respondent. For Petitioner : Mr.R.Bhagawat Krishna For Respondents : Mr.M.Veerabathran Prasanth, Government Counsel ORDER The relief sought in this Writ Petition is to quash the Proceedings dated 14.07.2026 bearing No.Na.Ka.8466/2025/E2 issued by the 3rd Respondent directing the Petitioner to vacate the property comprised in S.Nos.927 & 928 measuring a total extent of 4,837 Sq.ft situated at Door No.94 & 95, Vijayapuram, Thiruvarur Taluk and District (hereinafter referred to as “subject property”) and consequently, direct the 3rd Respondent not to take any further steps for evicting the Petitioner from the subject property till the disposal of R.P.No.101 of 2025 on the file of the 1st Respondent. 2. The learned counsel for the Petitioner submitted that Petitioner and his two brothers viz., Mr.Suresh and Mr.Ramesh are in joint possession and continuous enjoyment of the subject property as tenants. W.P.No.28723 of 2026 __________ Page3 of 7 administration of the temple viz., M/s.Arulmigu Renugadevi Amman Thirukoil claimed ownership over the subject property and demanded the Petitioner & his brothers to pay the arrears of rent.
As on date, Petitioner and his brothers paid a sum of Rs.14,17,376/- towards arrears of rent to the administration of Arulmigu Renugadevi Amman Thirukoil. 2.1. It is further submitted by the learned counsel for the Petitioner that 3rd Respondent had filed a petition in M.P.No.108 of 2023 before the 2nd Respondent seeking to evict the Petitioner and his brothers from the subject property. The 2nd Respondent vide Order dated 28.01.2025, disposed of M.P.No.108 of 2023 by observing that Petitioner and his brothers shall vacate the subject property and hand over the vacant possession of the subject property to Arulmigu Renugadevi Amman Thirukoil, within a period of 15 days from the date of receipt of a copy of this order, failing which, 3rd Respondent along with Police protection shall evict the Petitioner and his brothers from the subject property and hand over the vacant possession of the same to the temple administration. 2.2. Aggrieved by the aforesaid order passed by the 2nd Respondent, Petitioner and his brothers have filed a Revision Petition in R.P.No.101 of 2025 before the 1st Respondent praying to set aside the Order dated 28.01.2025 in M.P.No.108 of 2023 passed by the 2nd Respondent and to direct the https://www.mhc.tn.gov.in/judis
W.P.No.28723 of 2026 __________ Page4 of 7 Respondents 2 to 4 to remove their entries in all the Revenue Records pertains to the subject property. Further, Petitioner and his brothers have filed an Interlocutory Application in M.P.No.108 of 2023 praying to grant an order of interim stay of operation of the Order dated 28.01.2025 in M.P.No.108 of 2023 passed by the 2nd Respondent, till the disposal of R.P.No.101 of 2025. Now, the said Revision Petition is pending adjudication before the 1st Respondent. 2.3. The learned counsel for the Petitioner also submitted that while the aforesaid Revision Petition is pending, 3rd Respondent has issued the impugned Proceedings dated 14.07.2026 informing that Petitioner and his brothers shall vacate the subject property, on or before 24.07.2026.
Aggrieved by the same, Petitioner has filed the present Writ Petition for the relief stated supra. 3. On the other hand, the learned Government Counsel appearing on behalf of the Respondents has produced a copy of the Communication dated 21.07.2026 addressed to the Government Advocate, Madras High Court by the 4th Respondent, wherein, it has been stated that till date, Petitioner and his brothers have paid a sum of Rs.13,00,000/- towards rent to the administration of Arulmigu Renugadevi Amman Thirukoil and the outstanding balance of rent payable by them to the temple administration is Rs.31,06,108/-. It has also been stated that an application has been submitted before the District Sub Registrar Office, Thiruvarur for fixing a fair rent and once the fair rent is fixed, the https://www.mhc.tn.gov.in/judis
W.P.No.28723 of 2026 __________ Page5 of 7 Petitioner and his brothers shall pay the said fair rent to the administration of Arulmigu Renugadevi Amman Thirukoil. Therefore, the learned Government Counsel prayed that appropriate direction may be issued to the Petitioner to pay the outstanding balance of rent to the administration of Arulmigu Renugadevi Amman Thirukoil. 4. Heard the learned counsel on either side and perused the materials available on record. 5. Considering the facts and circumstances of the case and having regard to the submissions made by the learned counsel on either side, this Court is inclined to stay the order passed by the 2nd Respondent. Accordingly, there shall be an order of interim stay of operation of the Order dated 28.01.2025 in M.P.No.108 of 2023 passed by the 2nd Respondent, till the disposal of R.P.No.101 of 2025 on condition that Petitioner shall pay a sum of Rs.15,00,000/- (Rupees Fifteen Lakhs only) towards outstanding balance of rent to the administration of Arulmigu Renugadevi Amman Thirukoil, within a period of three weeks from the date of receipt of a copy of this order. 6.
It is made clear that if the Petitioner fails to make the aforesaid payment, the order of interim stay now granted by this Court shall stand automatically vacated, without any further reference to this Court and it is open https://www.mhc.tn.gov.in/judis
