For Applicant(s): Mr.G.Abraham Prabhu O R D E R This Application has been filed by the 3rd defendant seeking leave of this Court to receive additional documents and take the same on record. 2.Heard the learned counsel for the petitioner and perused the averments in the affidavit filed in support of the application and the documents sought to be produced and the other materials available on record. __________ Page1 of 3 https://www.mhc.tn.gov.in/judis A No. 1847 of 2026 3.The applicant has stated that the documents could not be filed along with the written statement as some of the documents were not in her possession at the relevant point of time and certain other documents were stated to be with the Bank. It is further stated that the documents are relevant and necessary for the effective adjudication of the suit. 4.However, on a careful perusal of the documents now sought to be received, this Court finds that there is no proper indication or clarification as to whether the documents produced are the original documents or mere xerox copies. The nature and status of the documents sought to be received have not been clearly established. In the absence of such basic particulars, this Court is unable to satisfy itself as to the authenticity and evidentiary nature of the documents sought to be brought on record. 5.In view of the above, this Court is not inclined to exercise its discretion in favour of the applicant.
