3. Petitioner raised a pucca construction in which he is running a ‘Maggie Point’. Since the construction was at the banks of river Sahastradhara, show-cause notice dated 09.02.2026 was issued to the petitioner to remove the construction, failing which, it was directed that the demolition shall be done by the MDDA at the cost of petitioner. The petitioner filed a reply showing cause, however, the said reply did not find favour with the respondent-MDDA, and finally the demolition order dated 10.03.2026 was passed. Petitioner, feeling aggrieved by the aforesaid demolition order dated 10.03.2026, preferred appeal before the appellate authority i.e. Commissioner, Garhwal Division being Appeal No.62 of 2025-2026 along with an application therewith to stay the demolition order.
4. In the appeal filed by petitioner, learned Commissioner, Garhwal Division has sent for the report and summoned the records but no order has been passed on the stay application filed by petitioner in the said appeal. Present petition has been filed by petitioner seeking to quash the order

dated 04.05.2026 passed by respondent-authority and further a writ of mandamus has been sought directing the respondents not to issue any order against the property of petitioner till disposal of Appeal No.62/2025-2026 (Kripal Singh v. MDDA).

Since the appeal against the demolition order dated 10.03.2026 is pending before the learned Commissioner, Garhwal Division, therefore, at this stage, this Court cannot pass any order in protection of petitioner except to direct the expeditious disposal of the application for stay of demolition order, impugned in appeal.
6. In this view of matter, present writ petition is finally disposed of by directing that the Commissioner, Garhwal Division shall decide the stay application moved by petitioner in Appeal No.62/2025-2026 on the next date fixed i.e.
28.05.2026.
7. Till the stay application is decided, no coercive measure(s) shall be taken against the petitioner in respect of the subject property.
8. Let a copy of this order be issued to the parties, today itself, as per rules.
