The petitioner is apprehending his arrest in connection with arrested in connection with Bariyatu P.S. Case No. 58 of 2024, for the offence registered under Sections 318 (3) of Bhartiya Nyaya Sanhita, 2023, under section 4(1) (A), 21 of Mines and Minerals (Development & Regulation) Act and under Rule 5(i), 9, 13(i) of Jharkhand Minerals (Prevention of Illegal Mining, & Storage) Rules, 2017, Transportation, pending in the Court of Learned Judicial Magistrate, 1st Class, Latehar. 3. Learned counsel appearing for the petitioner submits that the petitioner is the director of Pranabnaman Mineral Pvt. Ltd. (PNM), a registered company engaged in lawful coal handling, loading and transportation work of coal and a valid Letter of Award was issued by Central Coalfields Ltd. (CCL), Magadh Sanghmitra Area, contained in Annexure-2. Learned counsel appearing for the petitioner submits that in light of the said award, the company was authorized to carry out of loading and transporting of coal from Magadh OCP to Fulbasiya Railway Siding as per the directions of the Engineer-in-Charge and all the activities have been conducted strictly in the supervision of the CCL 2026:JHHC:2726 2 officials and the FIR has been lodged against all the transporters including the officers of CCL. It has also been submitted that eight of the CCL officials have been granted anticipatory bail in ABA No. 6260 of 2025. 4. Learned counsel appearing for the State opposed the prayer and submits that the allegations are there of illegal transportation of the coal. 5. Annexure-2 is the document, which suggests that the said company has been awarded contract of lifting of the coal. Petitioner happened to be the director of the said company and the allegations are there against several persons of indulging in illegal mixing of the coal with the ashes. Eight CCL officers have been granted anticipatory bail in ABA No. 6260 of 2025. In that view of the matter, I am inclined to grant anticipatory bail to the petitioner. 6. Accordingly, the petitioner, above named, is directed to surrender before the learned Court within three weeks from the date of receipt of the order and on the event of his surrender / arrest, he shall be released on bail on furnishing bail bond of Rs.25,000/- (Twenty-Five Thousand) with two sureties of the like amount of each to the satisfaction of learned Judicial Magistrate, 1st Class, Latehar, in connection with Bariyatu P.S. Case No. 58 of 2024, subject to the condition as laid down under Section 482(2) of Bharatiya Nagarik Suraksha Sanhita, 2023. 7.
