The petitioner named above has been made accused in connection with Kairo P.S. Case No. 22 of 2024 (Spl. POCSO Case No. 33 of 2024) for the offence registered under Section 376 of the Indian Penal Code and section 6 of the POCSO Act, pending in the court of learned Additional Sessions Judge-1-cum Special Judge POCSO, Lohardaga. Earlier the prayer for bail of this petitioner was rejected by the Co-ordinate Bench of this Court on merit and instant prayer for bail of the petitioner is being renewed on the ground that the petitioner is languishing in jail custody since 03.05.2024 and the trial has not been concluded as yet. Learned counsel for the State has opposed the prayer for bail and submitted that the bail of the petitioner has been rejected twice by the Trial Court and seven witnesses have been examined. On perusal of the earlier order, it appears that the regular bail of the petitioner was earlier rejected on merit, considering the nature of offence and stage of trial, I am not inclined to grant bail and I do not find any change of circumstance for renewing his prayer for bail.
