Heard learned counsel for the parties.

The instant bail application has been preferred by the petitioner for grant of regular bail for the offences registered under Sections 132 of the BNS and under Sections 20(b)(ii)(B)/21(b)/22 of the NDPS Act in connection with NDPS Case No. 121 of 2024 arising out Sukhdeonagar PS Case No. 451 of 2024(N).

Learned counsel for the petitioner submits that the petitioner is innocent and has not committed any offence. Learned counsel for the petitioner submits that recovery of 3.060 KG Ganja as well as 8.5 Gram brown sugar have been shown from the joint possession of the petitioner and the co-accused, namely, Chintu Kumar but the place of recovery as per the FIR is house of one Kameshwar Rai and not the premises of this petitioner. He further submits that recovered quantity of contrabands is intermediary in nature and the petitioner is lying in judicial custody since 29.08.2024 as such the petitioner may be enlarged on bail.

Learned APP opposes the prayer for bail of the petitioner.

Having regard to the above coupled with the fact that the petitioner is in custody since 29.08.2024, I am inclined to enlarge the

petitioner on bail. Accordingly, the petitioner, above-named is directed to be released on bail on furnishing bail bond of Rs. 20,000/- (Rupees Twenty Thousand only) with two sureties of the like amount each to the satisfaction of learned AJC-VI, Ranchi in connection with NDPS Case No. 121 of 2024 arising out Sukhdeonagar PS Case No. 451 of 2024(N).

It is made clear that the petitioner shall appear on each and every date before the learned trial Court and he shall not threaten any witness and shall co-operate in trial and if any adverse report will come against the above-named petitioner, learned trial Court shall be at liberty to cancel the bail of the above-named petitioner.

Accordingly, the instant bail application stands allowed.
